1. General
These Terms and Conditions govern the sale of goods by Inkymole's Motors ("we", "us", "our") to any customer ("you", "your"). By placing an order, you agree to be bound by these terms.
2. Goods Sold
We sell both new and used (second-hand) vehicle parts. The condition and functionality of each item will be clearly stated at the point of sale. Used parts are sold as described, and may have signs of wear consistent with age and usage.
3. Ordering and Payment
- Orders may be placed online, by phone, email, or in person.
- All prices are in GBP unless otherwise stated (the drop-down menu allows you to see prices in your own currency).
- Full payment must be received before dispatch or collection.
- We reserve the right to refuse or cancel any order at our discretion.
4. Delivery
- We aim to dispatch goods within 4 working days of receiving payment.
- We aim to dispatch made-to-order or customised goods as soon as possible after receiving payment. We will always advise on an expected timescale and keep you informed.
- Delivery costs will be clearly displayed prior to purchase.
- Risk passes to you upon delivery.
5. Returns and Cancellations
Consumers (Distance Selling / Online)
- You have the right to cancel your order within 14 days of receiving the goods (Consumer Contracts Regulations 2013).
- To cancel, contact us in writing (this can be email) within the 14-day period.
- Goods must be returned in their original condition at your cost.
- We will refund the original purchase price and standard delivery charge within 14 days of receiving returned goods.
Exclusions
- Returns are not accepted for bespoke or modified items.
- Used parts are sold as seen and may not be eligible for refund unless faulty or misdescribed. Used or second-hand parts will not be accepted for return if they have been installed. We take great care to ensure parts are functional, but this cannot be guaranteed. If you would like further photos of an item before ordering, please ask. Please ensure you have satisfied yourself that any product ordered is right for you and your vehicle.
6. Warranty
Parts which have been installed, used, modified, or show signs of fitting may not be eligible for return unless a manufacturing defect is confirmed following inspection.
NEW PARTS
- New parts come with a manufacturer’s warranty (typically 12 months unless otherwise stated) against manufacturing defects; this warranty lies with the manufacturer and they reserve the right to refuse exchange if the part has been incorrectly installed or damaged due to negligence. If you have any questions please contact us.
- Where a fault is established within the first 6 months, we reserve the right to repair or replace the goods in the first instance before any refund is considered.
- After 6 months from delivery, the burden of proof lies with the customer to demonstrate that any alleged defect was present at the time of sale, in accordance with the Consumer Rights Act 2015.
USED PARTS
- Used parts are sold without warranty, unless expressly stated otherwise in writing. We take great care to ensure parts are functional, but this cannot be guaranteed. If you would like further photos of an item before ordering, please ask.
- Where a part is supplied for installation by you or your choice of installer, we have no control over or liability for that installation. Warranty Claims are only permitted on parts and under no circumstance will any payment or goodwill be given to compensate labour or associated costs.
- We are not responsible for damage caused by incorrect installation, misuse, or failure to follow manufacturer guidelines.
- It is the responsibility of the vehicle owner to ensure the vehicle complies with roadworthiness regulations once parts are fitted.
- Where a fault is alleged, we reserve the right to inspect and/or test the goods before agreeing to any repair, replacement or refund. Goods must not be returned without prior written authorisation.
- Some of the products we sell are aftermarket or performance components intended to modify a vehicle from its original factory specification. It is the customer’s responsibility to ensure compatibility, correct installation, adjustment and ongoing roadworthiness of the vehicle following the fitting of any parts and accessories.
7. Liability
- Our liability is limited to the cost of the item purchased.
- We shall not be liable for any indirect, consequential, or incidental damages.
- Nothing in these terms limits or excludes liability for death or personal injury caused by negligence, fraud, or any other liability which cannot be excluded under English law.
8. Trade Customers
- Trade customers purchasing for resale or business use waive certain consumer rights.
- Used parts sold to trade are non-returnable, unless misdescribed.
9. Title and Risk
- Goods remain our property until paid in full.
- Risk transfers to you upon delivery or collection.
10. Privacy and Data
- We handle your data in accordance with the UK GDPR and Data Protection Act 2018.
- We do not share your information with third parties except where necessary to fulfil your order.
11. Governing Law
These terms are governed by the laws of England and Wales. Any disputes will be subject to the jurisdiction of the English courts.
